Critz (PA-12) announced today that the House Armed Services Committee has passed the Fiscal Year 2013 National Defense Authorization Act, including an amendment requiring that armor steel plate procured for defense purposes is melted in the United States. </font></span></span></p><p class="MsoHeader" style="margin: 0in 0in 0pt"><o:p><span style="font-size: larger"><span style="font-family: Verdana"><font color="#000000">&nbsp;</font></span></span></o:p></p><p class="MsoHeader" style="margin: 0in 0in 0pt"><span style="font-size: larger"><span style="font-family: Verdana"><font color="#000000">The Brooks-Critz-Ryan Amendment restores a nearly 40-year precedent of ensuring that armor steel plate be melted domestically, a policy critical to the future viability of the armor plate industry and its workers, as well as to the nation&rsquo;s national defense.&nbsp; The current Defense Department rule defines the term &ldquo;produced,&rdquo; as it relates to armor plate, in such a way as to allow the product to be made with metals melted and rolled outside of the United States, merely requiring that late-stage finishing processes take place domestically.&nbsp; </font></span></span></p><p class="MsoHeader" style="margin: 0in 0in 0pt"><o:p><span style="font-size: larger"><span style="font-family: Verdana"><font color="#000000">&nbsp;</font></span></span></o:p></p><p class="MsoHeader" style="margin: 0in 0in 0pt"><span style="font-size: larger"><span style="font-family: Verdana"><font color="#000000">&ldquo;The Defense Department&rsquo;s definition of &lsquo;domestically produced&rsquo; armor steel plate threatens our industrial base by increasing our reliance on foreign suppliers at the expense of American steel workers,&rdquo; said Congressman Critz, a Member of the House Armed Services Committee who cosponsored the amendment and voted for final passage of the FY13 National Defense Authorization Act.&nbsp; &ldquo;It&rsquo;s absurd to call a product &lsquo;Made in America&rsquo; if it is melted and rolled in China and only tempered here in the states.&nbsp; This current definition is unacceptable, and the Brooks-Critz-Ryan amendment ensures that the Defense Department procures armor steel plate that is produced in the United States.&rdquo;</font></span></span></p><p class="MsoHeader" style="margin: 0in 0in 0pt"><o:p><span style="font-size: larger"><span style="font-family: Verdana"><font color="#000000">&nbsp;</font></span></span></o:p></p><p class="MsoHeader" style="margin: 0in 0in 0pt"><span style="font-size: larger"><span style="font-family: Verdana"><font color="#000000">The Amendment, which is critical to domestic steelmaking jobs as well as jobs throughout the raw materials supply chain, was authored by Representatives Mo Brooks (R-AL), Mark Critz (D-PA) and Tim Ryan (D-OH).&nbsp; The legislation must now be considered by the full House of Representatives, which will occur as early as next week.&nbsp; The Brooks-Critz-Ryan Amendment was strongly supported by the United Steelworkers, the Alliance for American Manufacturing, Allegheny Technologies Inc., ArcelorMittal, and Nucor (<a href="http://critz.house.gov/letter%20in%20support%20of%20Brooks-Critz-Ryan%20amendment.pdf">see attached letter</a>).</font></span></span></p><p>&nbsp;</p>]]>

&nbsp;</span></span></div><div><span style="font-size: larger"><span style="font-family: Verdana">&nbsp;</span></span></div><div><span style="font-size: larger"><span style="font-family: Verdana">Dear Secretary Panetta and Secretary LaHood:</span></span></div><div><span style="font-size: larger"><span style="font-family: Verdana">&nbsp;</span></span></div><div><span style="font-size: larger"><span style="font-family: Verdana">We write to express our serious concerns over the reduction in safety and efficiency of the airspace over western Pennsylvania and the surrounding areas as a result of the Air Force&rsquo;s proposal to close the 258th Air Traffic Control Squadron (ATCS) in Johnstown, PA.</span></span></div><div><span style="font-size: larger"><span style="font-family: Verdana">&nbsp;</span></span></div><div><span style="font-size: larger"><span style="font-family: Verdana">On March 29, 2012, Members of the Pennsylvania Congressional Delegation met with senior Air Force officials to discuss the details, both classified and unclassified, behind various &ldquo;military judgments&rdquo; that were made regarding the Air Force&rsquo;s Total Force Restructuring plan.&nbsp; Specifically, the Air Force has decided to reduce the total number of ATCSs in the Air National Guard (ANG) by two, including the 258th in Johnstown.&nbsp; At that meeting, it was pointed out that the 258th not only has an exemplary record of deployed military service, but also handles more combined radar/tower traffic than any other ATCS, has the newest facilities, and supports a training mission for the entire ANG providing Special Experience Identifiers (SEIs) that most other squadrons cannot provide.&nbsp; Additionally, the 258th actual controls Federal Aviation Administration (FAA) airspace- something which no other ATCS does.</span></span></div><div><span style="font-size: larger"><span style="font-family: Verdana">&nbsp;</span></span></div><div><span style="font-size: larger"><span style="font-family: Verdana">In response, the Air Force stated that the decision to close the 258th (and the 259th in Louisiana) was based on the lack of a co-located operational unit.&nbsp; When it was pointed out that the 258th is co-located and supports the 1st Battalion, 104th Aviation Regiment of the Army National Guard&rsquo;s 28th Combat Aviation Brigade, that statement was amended to a &ldquo;lack of co-located Air Force operational unit.&rdquo;&nbsp; Their response did not adequately address the delegations concerns regarding the transition of the training and airspace control functions, and so a written follow-up response was requested.</span></span></div><div><span style="font-size: larger"><span style="font-family: Verdana">&nbsp;</span></span></div><div><span style="font-size: larger"><span style="font-family: Verdana">That follow-up response, received April 9, 2012, stated that the current training program would be &ldquo;redistributed amongst the remaining ANG ATC squadrons.&rdquo;&nbsp; While there are six other locations that can provide real-time training, none can do so in FAA controlled airspace using the newest STARS/DASR systems.</span></span></div><div><span style="font-size: larger"><span style="font-family: Verdana">&nbsp;</span></span></div><div><span style="font-size: larger"><span style="font-family: Verdana">Regarding the FAA airspace control, the Air Force responded that &ldquo;airspace is granted by the FAA to the military so air traffic control personnel can hone their skills and remain proficient in performing air traffic control duties to meet wartime requirements.&nbsp; With the divestiture of the 258th ATCS, there would be no wartime requirement to train wartime controllers there, and therefore, no airspace would need to be delegated to Johnstown; FAA [the Cleveland Air Route Traffic Control Center (ARTCC)] would then reassume airspace responsibilities.&nbsp; Since Congress has not yet passed the FY13 budget proposal, the FAA and NGB staffs have not coordinated on these plans.&rdquo;&nbsp; It is deeply concerning to us that something as complex and dynamic as a transfer of airspace control would be treated so lightly, and that the impact of this proposal was never discussed with the FAA.</span></span></div><div><span style="font-size: larger"><span style="font-family: Verdana">&nbsp;</span></span></div><div><span style="font-size: larger"><span style="font-family: Verdana">Cleveland ARTCC has expressed some very real concerns with this decision.&nbsp; A recent FAA memorandum from the Support Manager for Airspace and Procedures at Cleveland ARTCC to the Department of the Air Force&rsquo;s Johnstown Air Traffic Manager dated April 27, 2012 (enclosed), states &ldquo;over the last several years a substantial amount of time, as well as human and fiscal resources, were expended by the FAA in the development and implementation of the Johnstown Radar Approach Control (RAPCON).&nbsp; The opening of this RAPCON was prompted by the need to provide greater safety and efficiency&rdquo; and to &ldquo;help pave the way for&rdquo; badly need air traffic control upgrades, such as the FAA&rsquo;s NextGen project.&nbsp; The memo goes on to say that &ldquo;the closure of [Johnstown&rsquo;s] RAPCON and reabsorption of airspace by [Cleveland ARTCC] would cause irreparable harm in our ability to carry out the FAA&rsquo;s vision of safety, efficiency, cost effectiveness and community.&rdquo;&nbsp; It is clear that while closure of the 258th may provide a short-term cost savings to the Air Force, it will undoubtedly lead to increased costs to the Army National Guard units that the ATCS supports, the training mission of the Air National Guard, and to the Federal Aviation Administration.&nbsp; In our opinion, this kind of stove-piped decision making is the worst kind of fiscal irresponsibility.</span></span></div><div><span style="font-size: larger"><span style="font-family: Verdana">&nbsp;</span></span></div><div><span style="font-size: larger"><span style="font-family: Verdana">The bottom line is that the 258th provides to the Air Force and the Air National Guard both the newest facilities and premier real life operational density, in addition to providing essential services to both the Army National Guard and the FAA.&nbsp; Critz (PA-12) announced today that he is a cosponsor of legislation to stop student loan interest rates from doubling later this year.&nbsp; In 2007, Congress passed the College Cost Reduction and Access Act, which reduced the fixed rate on subsidized Stafford loans for undergraduate students from 6.8% to 3.4% over a four year period.&nbsp; Without Congressional action, rates will return to 6.8% on July 1, 2012. </font></span></span></p><p class="MsoHeader" style="margin: 0in 0in 0pt"><o:p><span style="font-size: larger"><span style="font-family: Verdana"><font color="#000000">&nbsp;</font></span></span></o:p></p><p class="MsoHeader" style="margin: 0in 0in 0pt"><span style="font-size: larger"><span style="font-family: Verdana"><font color="#000000">&ldquo;Coming from a family of educators, I have always believed that we must promote an educational system that affords all students the opportunities of higher education and career training programs,&rdquo; said Congressman Critz.&nbsp; &ldquo;At a time of ever-increasing education costs, and the challenging job market graduates face, we cannot let interest rates on federal Stafford loans double this year and cost students and families thousands of extra dollars.&rdquo; </font></span></span></p><p class="MsoHeader" style="margin: 0in 0in 0pt"><o:p><span style="font-size: larger"><span style="font-family: Verdana"><font color="#000000">&nbsp;</font></span></span></o:p></p><p class="MsoHeader" style="margin: 0in 0in 0pt"><span style="font-size: larger"><span style="font-family: Verdana"><font color="#000000">The legislation Critz is a cosponsor of, H.R. 3826, will prevent subsidized Stafford student loan rates from doubling from 3.4% to 6.8% by extending the 3.4% interest rate for these loans.&nbsp; In order to receive a subsidized Stafford Loan, you must demonstrate financial need.&nbsp; About two thirds of subsidized Stafford loans are awarded to students with families making under $50,000; one fourth to students with families making $50,000 to $100,000; and a little less than 10% to students with families making over $100,000.&nbsp; This issue also cuts across age groups impacting students, parents and even grandparents, many of whom cosign loan notes that students take out.</font></span></span></p><p class="MsoHeader" style="margin: 0in 0in 0pt"><o:p><span style="font-size: larger"><span style="font-family: Verdana"><font color="#000000">&nbsp;</font></span></span></o:p></p><p class="MsoHeader" style="margin: 0in 0in 0pt"><span style="font-size: larger"><span style="font-family: Verdana"><font color="#000000">Earlier this year, President Obama called on Congress to prevent this doubling of student loan rates.&nbsp; &ldquo;We must take action to protect middle class families and their children from higher loan rates during this challenging economic time,&rdquo; added Congressman Critz. </font></span></span></p><p>&nbsp;</p>]]>

in a deliberate effort to close postal centers outside the review and appeals process.&nbsp; Over the past few months, my office has discovered multiple instances where lease holders have agreed to the exact terms set forth by the USPS, only to be told after agreeing to these terms that these centers would be closing anyway.&nbsp; </i></div><div>&nbsp;</div><div><i>As you may know, I am strongly opposed to the postal closings that have been identified by the Retail Access Optimization Initiative (RAOI) study, which has identified 33 postal centers for closure within my Congressional District.&nbsp; It has been well established that these closings are rejected by the communities involved, and that the public meetings held to this point to discuss these closures have fallen well short of the expectations of a public meeting.&nbsp; The lack of information has left citizens uninformed and deeply suspicious of the USPS and its motives for closure, particularly when it appears that rural communities have been unfairly targeted.</i></div><div>&nbsp;</div><div><i>The postal centers that I am bringing to your attention are not associated with the over 3,600 identified by the RAOI study, but rather are leased centers that appear to be targeted for closure under the false pretext of failed rental negotiations.&nbsp; My fear of this practice is based on the numerous complaints my office has fielded concerning lease agreements for postal centers in Westmoreland and Somerset Counties, Pennsylvania.&nbsp; These centers, located in Derry, East Vandergrift, New Florence and Sipesville, are currently set to close because of &ldquo;unreasonable&rdquo; lease holders.&nbsp; </i></div><div>&nbsp;</div><div><i>Property owners in Derry and East Vandergrift have provided me with their former lease agreements as well as the newly negotiated terms.&nbsp; In both instances, the current lease holder agreed to the terms as proposed by the USPS - only to be given a notice of lease termination.&nbsp; Such closings take place without public meeting and without any means of appeal from the affected communities.</i></div><div>&nbsp;</div><div><i>It is difficult to grasp how a lease holder, who has agreed to the new terms of a lease by offering a substantial cut in rent, can be then termed &ldquo;unreasonable.&rdquo;&nbsp; That these centers are targeted for closure, despite accepting the terms as set forth by the USPS, leaves one to believe that the USPS is using these talks as a means to close centers without any sort of public review or the ability for the public to appeal as set forth in the current governing regulations.&nbsp; In other words, I fear that the USPS believes it has identified a loophole through which they are free to close hundreds, if not thousands, of postal centers without question.&nbsp; </i></div><div>&nbsp;</div><div><i>In New Florence, the lease holder has provided detailed information where the USPS asked for a 10 percent reduction in rent and a 180-day out clause.&nbsp; The lease holder agreed to the rent reduction but raised objection to the notion of such an &ldquo;out clause&rdquo; because it makes the length of a lease pointless.&nbsp; Without further discussion, the USPS sent a termination notice.&nbsp; The lease holder maintains that had any actual negotiations taken place, they would have agreed to the out clause and even now stands ready to rent the center at the reduced rate with the clause as requested by the USPS.&nbsp; Even on this level, it is difficult to see how this constitutes a lease disagreement or an unreasonable lease holder.&nbsp; In this case, the lease holder is not an individual citizen with limited assets unaccustomed to market pressures, but rather a professional lease management company that certainly understands fair market value and the process of a reasonable negotiation.&nbsp; </i></div><div>&nbsp;</div><div><i>I am concerned with how widespread this problem may actually be.&nbsp; Just over the last few days, I discovered the pending closing of the Sipesville Post Office in Somerset County over another lease issue.&nbsp; This is a closing that was decided in January of last year, and has only now come to my attention as a result of my own review.&nbsp; I am troubled with how many other Post Offices might be in a similar situation, or are about to be.</i></div><div>&nbsp;</div><div><i>The American people deserve the truth in terms of what exactly the USPS is attempting to do. Already they feel as if information has been kept from them or that a &ldquo;feasibility study&rdquo; is in fact a foregone conclusion of closure.&nbsp; That lease holders who are agreeing to significant reductions are being labeled as &ldquo;unreasonable&rdquo; as a means to circumvent due process.&nbsp; This is unacceptable, and an explanation needs to be given.&nbsp; While no one expects the USPS to be held hostage by a truly &ldquo;unreasonable&rdquo; landlord, I do not believe that the law stipulates that the relationship between the USPS and the citizenry has anything to do with any one lease holder.&nbsp; In other words, the USPS inability to work a lease agreement with one landlord in a community does not give them the right to simply abandon that community.</i></div><div>&nbsp;</div><div><i>I request your immediate review of these concerns, and I strongly urge the Postal Regulatory Commission to investigate theses charges.&nbsp; Without immediate action, I fear that many of our postal centers will be unfairly closed without the benefit of a public review or appeal.</i></div><div>&nbsp;</div><div align="center"><i>Sincerely,</i></div><div align="center">&nbsp;</div><div align="center"><i>Mark S.
